Apple v. Samsung - Apple Seeks $2 Billion for Patent Infringement

Today, the federal district court for San Jose, California heard opening arguments in Apple v. Samsung which is their second major trial for patent infringement. Apple is now seeking Samsung pay $2 billion for infringement of five U.S. patents. Aggressive lawyering, the hyperbole - we could have sued on 50 patents and the judge has instructed you ... (when Judge Koh hadn't), an embarrassing "Holy war" email, each companies unabated ambition to be #1, and the billions at stake suggest this trial (like the first trial) will go to judgment.

Oracle v. Google - Copyright & Patent Trial - Groklaw Posts Trial Exhibits

To his credit Judge Alsup has insisted that the Oracle v. Google trial be as public as possible. Because of this stance, Groklaw was able to collect and post a PDF copy of the publicly available trial exhibits today. They are currently grouped by trial date but Groklaw is talking about matching each exhibit to the appropriate Groklaw article.

PTO Publishes Proposed Rules for Inter Partes Review, Post Grant Review, etc.

In February 2012, the USPTO announced publication of its proposed rules for contested cases, including inter partes review, post grant review, the transitional program for covered business methods, and derivation to implement the America Invents Act (AIA). See the details in the links below:

Publication opens a sixty-day comment period on the proposed rules. Director Kappos encouraged the patent community to comment on the rules and attend an AIA roadshow where the PTO will discuss proposed rules and receive public feedback.

See the Leahy-Smith America Invents Act Implementation web page for details and the AIA Roadshow schedule in 2012.
