USPTO - Major Power Outage and Service Interruption on December 22-25, 2015

The USPTO stated it had "a major power outage on December 22, 2015, damaging equipment that required the subsequent shutdown of many of its online and IT systems. This includes its filing, searching, and payment systems, as well as the systems used by examiners across the country. As of December 24, the USPTO estimates that these systems will be impacted through at least the Federal holiday on Friday, December 25, 2015." 

"The USPTO web site at http://www.uspto.gov/blog/ebiz/ reports that under this emergency situation, it will consider each day from Tuesday, December 22, 2015, through Thursday, December 24, 2015, to be a “Federal holiday within the District of Columbia” under 35 U.S.C. § 21 and 37 C.F.R. §§ 1.6, 1.7, 1.9, 2.2(d), 2.195, and 2.196. Any action or fee due on these days will be considered as timely for the purposes of, e.g., 15 U.S.C. §§ 1051(b), 1058, 1059, 1062(b), 1063, 1064, and 1126(d), or 35 U.S.C. §§ 119, 120, 133, and 151, if the action is taken, or the fee paid, on the next succeeding business day on which the USPTO is open (37 C.F.R. §§ 1.7(a) and 2.196). 

A subsequent notice is anticipated to be issued as needed if the USPTO’s systems are not fully operational by Monday, December 28, 2015.

Correspondence

Under 37 C.F.R. §§ 1.6(a)(2), 2.195(a)(4), and 2.198, certain correspondence deposited in the Priority Mail Express® service of the United States Postal Service (USPS) in accordance with 37 C.F.R. §§ 1.10 or 2.198 will be considered filed on the date of deposit (as shown by the “date accepted” on the mailing label) with the USPS.

Thus, any paper or fee properly deposited in the Priority Mail Express® service of the USPS on Tuesday, December 22, 2015, Wednesday, December 23, 2015, or Thursday, December 24, 2015, in accordance with 37 C.F.R. §§ 1.10 or 2.198, will be considered filed on its respective date of deposit in the Priority Mail Express® service of the USPS (as shown by a “date accepted” on the mailing label).

Under 37 C.F.R. §§ 1.6(a)(4) and 2.195(a)(2), patent- and trademark-related correspondence transmitted electronically to the USPTO will be considered filed in the USPTO on the date the USPTO received the electronic transmission.

Thus, any patent- or trademark-related correspondence transmitted electronically to the USPTO on Tuesday, December 22, 2015, Wednesday, December 23, 2015, or Thursday, December 24, 2015, will be considered filed in the USPTO on the date the USPTO received the electronic transmission.
Patent correspondence successfully received by the USPTO through the Electronic Filing System (EFS-Web) and filed in compliance with the EFS-Web Legal Framework will receive the date indicated on the Acknowledgement Receipt. 

Trademark filings properly filed through TEAS, TEASi, and ESTTA will receive the date indicated in the e-mail confirmation sent at the time of a successful filing.

Payment Processing
 
The USPTO system outage has affected the ability for customers to process Patent Maintenance Fee payments and submit Deposit Account replenishments online via the Finance Online Shopping Page. Available alternatives include the following:

Patent Maintenance Fees:  Pay by wire or mail as instructed at www.uspto.gov/patents-maintaining-patent/maintain-your-patent. The payment date will be the date received at the USPTO unless you are using the certificate of mailing procedure set forth in 37 CFR 1.8 or the USPTO Priority Mail Express procedure set forth in 37 CFR 1.10.
 
Deposit Account Replenishment: Replenish by wire or mail as instructed at www.uspto.gov/learning-and-resources/fees-and-payment/deposit-accounts/deposit-account-replenishment-options. Note that replenishments will be processed as of the date received, but deposit account balances will not reflect these replenishments until USPTO systems are restored.
 
Public and Private Patent Application Information Retrieval (PAIR) are also impacted.
Status updates will be issued on the USPTO systems alert page (www.uspto.gov/blog/ebiz/) as they become available, as well as on the USPTO Facebook (www.facebook.com/uspto.gov (link is external)) and Twitter (www.twitter.com/uspto (link is external)) accounts.

USPTO - Windows 10/Microsoft Edge: Compatibility Issue for EFS-Web and Private PAIR Authentication

Today, the USPTO announced "For users who are updating their operating systems to Windows 10, please be aware that Windows 10 comes installed with a new web browser, Microsoft Edge, that does not support plug-ins and will not run Java. Because Java is required for authentication to EFS-Web and Private PAIR, this impacts your ability to access EFS-Web and Private PAIR via Microsoft Edge.

To access EFS-Web and Private PAIR using Windows 10, Oracle is recommending the use of alternative browsers such as Firefox and Internet Explorer. IE11 will also be available on Windows 10. USPTO - Multiple Systems Down for Maintenance on July 18 - 19, 2015

The USPTO announced it will "perform maintenance affecting multiple systems beginning at 8 p.m., Saturday, July 18 and ending at 5 p.m., Sunday, July 19 ET." This will affect public and private PAIR. For further details see USPTO Systems Status Page.

USPTO - Google Chrome No Longer Able to Access EFS-Web and Private PAIR After September 2015

On June 22, the USPTO announced "Google Chrome removed the default ability to use the Java plug-in for browser version 42. This impacts your ability to access EFS-Web and Private PAIR because Java is required for your authentication into these systems. Currently, Chrome has a temporary workaround that will allow you to use the Java plug-in so that you can continue to log into EFS-Web and Private PAIR: https://support.google.com/chrome/answer/6213033(link is external).

This workaround will only work through September 2015, when Google Chrome plans to end their support for Java plug-ins with their newest browser, Chrome versions 45 and above. Therefore, Chrome users using version 45 and above will no longer be able to use the workaround and thus will not be able to log into EFS-Web or Private PAIR.  Oracle is recommending the use of alternative browsers such as Firefox, Internet Explorer, and Safari. Let's see if Google develops a permanent solution for Chrome users that require these USPTO services.

Also the USPTO announced PAIR is unavailable 4:30 to 5:30 AM Eastern daily, i.e., no problem.

USPTO - Improvements to Private PAIR

Today, the USPTO announced improvements to Private PAIR, which gives online access to records of unpublished patent applications:
 
"Users can now self-administer, in real time, a number of routine administrative tasks that previously required the submission of a paper form. The new Private PAIR features enable self-administration of the following items:
  • Entity status changes (Micro, Small, or Regular Undiscounted)
  • Update Correspondence Address
  • Update Maintenance Fee Address
  • Request a new customer number
Entity status and correspondence address updates will be visible in the transaction history, and a copy of each change request will be uploaded to the Image File Wrapper (IFW).

Users may notice that all applications are set to Regular Undiscounted entity status by default upon initial filing until the application completes formalities review. Once this review is complete, the entity status will be updated based on any assertion of small or micro entity status.

The Address & Attorney/Agent tab has also been enhanced to include complete information for Correspondence Address, Maintenance Fee Address and Power of Attorney information."

USPTO - Java 8 May Cause EFS-Web and Private PAIR Authentication Issues

The USPTO has alerted the community that Oracle's first version of Java 8 may cause authentication issues for users of Private PAIR and EFS-Web.  If Java 8 is an issue, the USPTO says revert to Java 7 update 51.

Here's the USPTO notice that arrived late last night:

"Oracle has announced that the first version of Java 8 will be released on Tuesday, March 18, 2014. This version will not be an automatic update, however if you install Java 8 and encounter authentication issues, you will need to revert to Java 7 Update 51.

USPTO technical teams are coordinating closely with Oracle and Entrust for a solution.

USPTO - EFS and Private PAIR - Updated Jan. 20, 2014

I regularly file papers with the electronic filing system (EFS) and review the status of non-published application on Private PAIR (patent application information retrieval). It is a cumbersome process but recently it got worse for some of us.

The USPTO notified some, it turns out me too, cannot authenticate themselves to the system beginning on or about January 15. If you cannot authenticate, the USPTO suggested to upgrade to Java 7 update 51. I also had to restart the computer after the update to resolve the authentication issue.

The USPO recommends if the authentication issue continues, contact the Patent Electronic Business Center from 6:00 am to 12:00 midnight (ET) Monday through Friday: 1-866-217-9197 or ebc@uspto.gov.

Now to authenticate on private PAIR or EFS you take the following steps:

1.  Click on digital certificate field or browse button, then an Entrust Publisher's dialog box appears "Do you want to run this application?" Click on the Run button and check the box you don't want to see this dialog again.

This displays the private PAIR login with the digital certificate file path and an empty password field.

2.  Check the box that "I understand that the technology in patent application may be subject to U.S. dual-use export controls (Without step 2, you may not be able to insert the digital certificate).

3.  Browse on your computer to the digital certificate and double click on it to insert the certificate into login field.

4.  Type your password.

5.  Click on the authenticate button.

USPTO - E-Office Action Delay on April 24-25

Today, the USPTO notified the e-Office Action program wasn't able to automatically send emails so was sending them manually. Still my experience with the Electronic Business Center is it has given great service.

Here's the USPTO notice describing the problem and interim remedy:

Due to a system issue, the e-Office Action process is currently experiencing a problem with sending emails to external email addresses. Automatic Email notifications have been delayed for e-Office Action participants on 4/24 and 4/25 – emails are currently being sent manually. We are working to resolve this problem and anticipate the e-Office Action program will be working again shortly. In the meantime, please go to the Outgoing Correspondence tab in Private PAIR to check if you have new correspondence from the Office. We will keep you informed with follow-up announcements. We apologize for the inconvenience.
Here are the step-by-step instructions to access your new correspondence:
1. Log into Private PAIR
2. Under the Search for Customer Number section, select the View Outgoing Correspondence radio button, select “7 days” from the “for the past” drop-down list

3. Leave the selection for Select Customer Number drop-down list at the default option, “All”

4. A list of new Office correspondence will be available for the last 7 days, including today's [sic, today]

Updated on April 26: The USPTO says e-Office Action problem is resolved.
